Buildmerce is a software product brand operated by Fasstech Soft from Pakistan. By using www.buildmerce.com, creating or activating a Buildmerce license, downloading a product or completing a purchase, you agree to these Terms & Conditions and any product-specific terms presented before purchase.

If you purchase on behalf of a company or client, you confirm that you are authorized to bind that organization to the applicable terms.

You must be at least 18 years old, or the age of legal majority where you live, and legally capable of entering into a binding agreement. Business users are responsible for ensuring that their purchase and use of Buildmerce products complies with their own organizational policies and local law.

Buildmerce sells digital software and related digital resources, including ecommerce extensions, plugins, modules, components, themes, design resources, updates and license entitlements. No physical goods are shipped unless a product page expressly states otherwise.

We aim to keep descriptions, screenshots, compatibility information, features and pricing accurate. Product behavior can nevertheless depend on your platform version, server configuration, third-party modules, theme customizations and other software outside our control.

Buildmerce remains the supplier and licensor of the software. Lemon Squeezy buyer terms may also apply to a transaction. If these Terms address software usage and Lemon Squeezy terms address payment processing, both can apply to their respective parts of the relationship.

Prices shown before checkout may exclude taxes that are calculated by the merchant of record based on billing location and applicable law.

Software is licensed, not sold, except where a product expressly states otherwise. Your rights are governed by the Buildmerce Software License Terms and any license tier, activation allowance, subscription period or product-specific condition shown at purchase.

You may not share license keys publicly, redistribute paid source code, resell a product as a standalone competing product, bypass licensing controls or use one license across more production installations than your purchased plan permits.

• Review the published compatibility, requirements and license tier before purchase.
• Maintain current backups and test changes in a staging or development environment before production deployment.
• Keep the underlying ecommerce platform, PHP runtime, dependencies and server environment within supported versions.
• Protect administrative credentials, license keys, API credentials and downloaded source code.
• Comply with applicable third-party platform licenses and terms.

Buildmerce is not responsible for losses caused by ignoring published requirements, modifying production without an appropriate backup, unsupported third-party conflicts or changes made by another provider.

Support and update entitlements vary by product and license tier. A stated support or update period begins on the purchase date unless the product page says otherwise. Our Support & Updates Policy forms part of these Terms.

An update entitlement does not guarantee that every future platform version, third-party module or custom theme will be supported. We may discontinue obsolete platform versions or products after reasonable consideration of security, maintainability and customer impact.

Products marked as subscriptions renew automatically at the interval displayed at checkout until canceled. Cancellation stops future renewal but does not automatically create a refund for the current paid period. The Subscription & Cancellation Policy applies to recurring products.

Refund requests are handled under our Refund Policy and any mandatory consumer rights that apply. Because software and digital content may be delivered immediately, refund eligibility can differ from physical goods. Lemon Squeezy, as merchant of record, may also exercise refund rights or discretion under its own policies.

Buildmerce and its licensors retain ownership of Buildmerce source code, product names, documentation, website content, graphics and other protected materials except for third-party or open-source components identified under their own licenses.

Adobe, Adobe Commerce, Magento, WooCommerce, WordPress, Hyvä, Shopify, BigCommerce and other third-party names and marks belong to their respective owners. References describe compatibility or intended platform use and do not imply sponsorship, endorsement or affiliation unless we expressly state otherwise.

• Unauthorized copying, redistribution, sublicensing or resale of paid Buildmerce software.
• Sharing, publishing, selling or trafficking in license keys or download credentials.
• Circumventing activation limits, signature checks, rate limits or other access controls.
• Using Buildmerce infrastructure to distribute malware, attack systems, violate law or infringe another party’s rights.
• Automated scraping or API traffic that materially disrupts the service or exceeds published limits.
• Fraudulent purchases, abusive refund practices, chargeback abuse or deliberate misrepresentation.

We may suspend or revoke access, licenses or support where reasonably necessary because of non-payment, a full refund, fraud, security risk, license abuse, material breach of these Terms or legal requirements. Where practical and safe, we will attempt to provide notice and an opportunity to resolve the issue.

Buildmerce products are provided on an “as available” basis to the maximum extent permitted by law. We do not guarantee uninterrupted operation, error-free software, compatibility with every third-party customization or a particular commercial result. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, Buildmerce and Fasstech Soft will not be liable for indirect, incidental, special, consequential or punitive losses, including lost profits, lost revenue, lost data or business interruption, arising from use or inability to use a product.

Where liability cannot be excluded, our aggregate liability relating to a specific paid product will not exceed the amount paid for that product during the 12 months preceding the event giving rise to the claim, except where applicable law requires a different result.

These Terms are governed by the laws applicable in Pakistan, without prejudice to mandatory consumer protections that may apply in your country of residence. Before starting formal proceedings, both sides are encouraged to contact the other and make a reasonable effort to resolve the issue in good faith.

We may update these Terms to reflect new products, legal requirements, security changes or business practices. Updated terms apply prospectively from the published effective date unless a change must apply sooner for legal or security reasons.
