1. License grant
Subject to payment of the applicable price and compliance with these terms, Buildmerce grants the customer a limited, non-exclusive, non-transferable and non-sublicensable license to install, run and modify the purchased software for the number and type of installations permitted by the purchased license tier.
The software is licensed, not sold. Ownership of Buildmerce intellectual property does not transfer to the customer.
2. Production installations and activation limits
A “production installation” is a live website, store or application serving real end users or conducting real business activity. The production activation allowance shown on the product page or checkout controls how many production installations may use the license at the same time.
Development, local, staging or testing installations may be treated separately by the licensing system where the product supports that distinction. They must still be used only for legitimate development or testing associated with licensed work and must not be used to avoid a production-site limit.
3. Agency and client use
Where an Agency or multi-site license expressly permits client installations, the license holder may deploy the software for qualifying client projects within the purchased activation allowance. Unless a product says otherwise, the agency may not transfer ownership of the Buildmerce license itself to the client or resell the source code as a standalone product.
A client who needs independent update, support or transfer rights should purchase an appropriate separate license unless the applicable plan expressly provides those rights.
4. Permitted modifications
You may modify Buildmerce source code for your own licensed implementation or qualifying client implementation. Modifications are made at your own risk and can affect support eligibility where a reported issue is caused by altered code.
You may create reasonable integration code around a Buildmerce product, but you may not package Buildmerce code or a derivative that substantially reproduces its protected functionality for independent resale or redistribution.
5. Restrictions
- Do not publish, upload, share, sell or redistribute paid Buildmerce source code or downloadable packages to unlicensed third parties.
- Do not share, sell or publicly expose a license key, claim link or customer download credential.
- Do not remove or bypass activation, entitlement, signature, rate-limit or anti-abuse controls for the purpose of exceeding purchased rights.
- Do not use the software to develop a directly competing redistributed copy that substantially consists of Buildmerce proprietary code.
- Do not falsely represent Buildmerce software as your original standalone product.
6. License keys and online validation
Some products use online license validation. The licensing service may process the licensed domain, installation identifier, environment classification, product version, platform version, PHP version, hashed IP-derived identifiers, user-agent information and activation events as described in the Privacy Policy.
You are responsible for keeping license keys confidential. If a key is exposed, contact Buildmerce so we can determine whether reissuance or revocation is appropriate.
7. Open-source and third-party components
A Buildmerce package may contain or depend on third-party or open-source components. Those components remain subject to their own licenses. Nothing in these terms restricts rights that an applicable open-source license independently grants to you.
8. Updates and version rights
Your right to receive new versions depends on the update term or subscription shown at purchase. Expiration of an update term does not automatically revoke a perpetual license to a version already validly obtained when the product was sold as a perpetual license.
For subscription-based products, hosted functionality or Pro features that expressly require an active entitlement may stop or become limited when the subscription expires. The product page and Subscription & Cancellation Policy control where a subscription is required for continued feature access.
9. Support
Support is governed by the Support & Updates Policy and the support period shown at purchase. Support does not include custom development, server administration, third-party debugging unrelated to the Buildmerce product or work made necessary by unsupported modifications unless separately agreed.
10. Ownership and feedback
Buildmerce and Fasstech Soft retain all rights not expressly granted. Product names, documentation, source code, original design assets and Buildmerce branding remain protected by applicable intellectual-property law.
If you voluntarily provide suggestions or feedback, you grant Buildmerce permission to use that feedback to improve products without an obligation to compensate you, provided we do not claim ownership of your pre-existing confidential material.
11. Suspension and termination
A license may be suspended or revoked after a full refund, confirmed fraud, unauthorized redistribution, deliberate license circumvention, severe abuse of Buildmerce infrastructure or another material breach. Upon termination for breach, you must stop the unauthorized use and remove copies that you are no longer entitled to retain.
12. Warranty, liability and governing law
Software is provided subject to the warranties and liability limitations in the Buildmerce Terms & Conditions, except where applicable law requires otherwise. These license terms are governed by the same governing-law provisions as the Terms & Conditions.
